Notice of Documentary Tax Change

Beginning July 18, 2026, documentary stamp taxes will increase by one dollar from $2.32 to $3.32 cents per $1,000 of value transferred. The county share of the fee will remain at 50 cents.

LB1067, which increased the rate, will direct the additional funds to the Rural Workforce Housing Investment Fund and the Middle Income Workforce Housing Investment Fund. The increased rate will be in place until January 2, 2032, when the rate will return to $2.32.

LB 254 - Provide New Requirements for Instruments recorded in the Office of Register of Deeds.  Effective August 27, 2011.

The Register of Deeds has the power to take acknowledgments, administer oaths, and certify the same by his or her signature. The Register of Deeds keeps a numerical and alphabetical record in which every instrument (deeds, mortgages, plats, surveys, etc.) filed for record in their office is entered. The Register of Deeds may appoint a deputy for whose acts the Register of Deeds will be responsible. The deputy may not be the county treasurer, sheriff, clerk or surveyor. In Phelps County a separate register of deeds is not elected pursuant to section 32-518, therefore the county clerk acts as ex officio Register of Deeds.

Effective January 1, 2013, the Register of Deeds fees will change, pursuant to Neb Rev. Stat.33-109, as amended by LB 14. Recording fees will be page 1 is $10.00 and all additional pages are $6.00 each.  The 50ยข indexing fee has been eliminated with LB 14.  Instruments not having at least a 3 x 3 inch space for recording information on the face of the document will require and additional $6.00 as another page will be used.   ROD Schedule of Recording Fees

As of July 16, 2004, UCC filings will be $10.00 plus $.50 per page for attachments. There will be no charge for terminations.
